Update – The AZ Tax Credit Bill (SB 1027) has been approved! We are delighted to report that, following months of testimony and advocacy by the Executive team at PWR!, Governor Ducey finally signed SB 1027 into law on June 7, 2019. Under the new law, the definition of qualifying organizations has been broadened to include nonprofits who serve individuals (rather than just children) with a chronic illness or physical disability. Based on the new guidelines, PWR! now meets the criteria for classification as a qualifying charitable organization. This change provides AZ residents, such as you, your friends and family, with an opportunity to reduce your state taxes while also supporting an organization that provides you with research-driven, Parkinson’s-specific therapies to slow the progression of the disease. Please note that the law is retroactive and accordingly, you may now take a credit of up to $400 (single AZ residents) or $800 (married AZ residents) against your 2019 state income tax liability for donations made to PWR! We want Arizona Senate Bill 1027 to succeed & here is why.

Currently, PWR! does not meet the criteria for a qualifying charitable organization since Parkinson's is an illness which is typically categorized as one that affects adults and not children. However, if the SB1027 is approved, organizations such as PWR! would be added to the list of qualifying charitable organizations. This change would provide AZ residents the opportunity to reduce their state taxes through a credit for donations made to organizations such as PWR!

Bottom line: you decide how to best direct your tax dollars.

Arizona Senate Bill 1027 was introduced by Senator Leach and assigned to the Finance Committee for consideration on January 14, 2019. SB1027 seeks to amend Section 43-1088 of the Arizona Revised Statutes which addresses individual income tax credits. On January 23, 2019, the Senate Finance Committee held a hearing to discuss the merits of the proposed amendment. At the conclusion of this hearing, the Committee recommended approval of the bill, voting 9-1 in favor. Following a series of caucuses, on February 5, 2019, the Senate issued its final vote to pass the bill, which was subsequently forwarded to the House of Representatives for consideration.

WHAT DOES THE CURRENT LAW STATE?
The current version of the law provides a tax credit in the amount of $400 to single taxpayers and $800 to married couples filing a joint return. Specifically, the statute provides that a credit is allowed for voluntary cash contributions by the taxpayer or on the taxpayer's behalf during the taxable year to a qualifying charitable organization. Qualifying charitable organizations are currently defined as nonprofit organizations whose budget is spent on services to residents of this state who either (1) receive temporary assistance for needy families benefits; (2) are low income residents of the state; or (3) are children who have a chronic illness or physical disability.

WHAT DOES THE AMENDMENT SEEK TO ACHIEVE?
SB1027 seeks to amend the definition of a qualifying charitable organization to include any non-profit organization that spends at least fifty percent of its budget on services to residents of this state who receive temporary assistance for needy families benefits, to low income residents of this state and their households, or to individuals who have a chronic illness or physical disability and who are residents of this state.

WHAT THIS WOULD MEAN FOR YOU AND PWR!
Currently, Parkinson Wellness Recovery does not meet the criteria for a qualifying charitable organization since Parkinson’s is an illness which is typically categorized as one that affects adults and not children. However, if SB1027 is approved, organizations such as Parkinson Wellness Recovery would be added to the list of qualifying charitable organizations.

This tax credit would have a profound impact on our ability to serve those in need. Chronic neurodegenerative diseases such as Parkinson’s pose a high burden with families often relying on Medicaid and nursing homes for care. By providing therapy, education and support to families, Parkinson Wellness Recovery allows patients to remain independent and living in their own homes for as long as possible. Therefore, expanding the definition of a qualifying organization makes perfect sense as it (1) helps to reduce the state’s costs, (2) the individual contributions allow organizations such as PWR! to fulfill its mission of helping those with Parkinson’s live better longer, and (3) it also provides AZ residents the opportunity to reduce their state taxes through a credit for donations made to organizations such as PWR!
